Court Cases Show Unlicensed Waste Disposal Doesn’t Pay

Whether you’re a business or a householder, using unlicensed waste carriers is likely to lead to prosecution –  costing you more than complying with waste disposal regulations.

In South Northamptonshire, council officers traced a householder who had accepted the offer of an unlicensed carrier to take the waste from his front garden.  The waste found its way to a farmer’s field in Northamptonshire where it was fly-tipped. The farmer reported the waste and investigating officers found the householders’ details among the fly-tipped waste. As  a result, Londoner Perry Bedeau  was fined £750, ordered to pay £436.32  costs, a £75 victim surcharge and £264 compensation to the farmer.

Also in Northampton, builder David Sellar was fined £1,000 and ordered to pay £349 costs when waste originating from a site he was working on in the town was dumped near  a village five miles away.

Other cases of hefty penalties for unlicensed carriers include an offender in Croydon, Gladstone Mark Buchanan, jailed for six months and ordered to pay £7413 costs for dumping a ‘staggering’ 42 tonnes on just one street in the borough. In Mid Devon, a woman was fined £200 each for two offences of fly tipping, plus a victim surcharge, and the people who generated the waste were identified.

Commenting on the Northamptonshire cases, Ian Davies, South Northamptonshire Council’s  Director  of Community and Environment, said:
“If the amount of money you are quoted to remove waste sounds too good to be true, then the waste is probably going to be fly-tipped. It will cost you a lot more in court than it would have done to go through a properly licensed waste carrier.”
